    Lead Traveler: the person (individual or legal entity) who made the reservation.

    Traveler(s): the person(s) who will occupy the Accommodation during the rental period.
    2. Traveler's Preliminary Declarations

    The Lead Traveler declares:

    • To be registered on the Website under their true identity and to have provided their true home address.

    • To have provided a phone number where they can be reached.

    • To be over 18 years old.

    • To have expressly accepted these General Rental Conditions.

    • To be informed that they do not benefit from the right of withdrawal pursuant to Article L121-21-8 of the Consumer Code.

    • To guarantee compliance with these conditions by all Travelers.
    3. Description and Characteristics of the Accommodation

    Accommodations offered for seasonal rental are described in an advertisement published on the Website or on Third-Party Rental Platforms.

    Each advertisement contains a description and photos of the Accommodation as well as the main characteristics of the Accommodation (location, maximum capacity, special requirements, etc.). The advertisement is written using the information provided by the Principal who is solely responsible for the information contained therein. Homerez cannot be held responsible for any defects, faults or, more generally, for any non-compliance of the Accommodation with the information provided in the advertisement.

    The Traveler is informed that the photos are as accurate as possible but cannot ensure a perfect similarity with the Accommodation offered.

    The information mentioned about the activities available in the area is provided by third parties for information purposes only (shops, transport, restaurants, visits, etc.) and Homerez cannot be held liable in this respect.
    4. Price

    The prices for the rental of the Accommodation are published on the Website or on Third-Party Rental Platforms. They may be set per night, per week or per month and may vary depending on the number of Travelers and the rental period. They are expressed in euros and include all taxes.

    Homerez reserves the right to modify these prices at any time, it being specified that the price applicable to the rental is the one indicated on the Website or the Third-Party Rental Platform at the moment of the booking of the Accommodation for the rental period indicated by the Lead Traveler.

    Some Accommodations can only be rented for a minimum period of time.

    Additional and/or optional charges may be invoiced in addition to the rental price. The details of these fees and the terms of payment are set out in the advertisement. By booking the Accommodation, the Lead Traveler expressly agrees to pay these fees in accordance with the conditions set out in the advertisement.

    The Traveler is informed that the rental price and any additional fees may be increased if the number of Travelers occupying the Accommodation exceeds the number of Travelers indicated by the Lead Traveler at the moment of the booking.
    4 bis. Display and payment currency

    Reference prices are set in euros. When the Traveler browses the Website in another currency (Canadian dollar or US dollar), the amounts displayed are converted using the European Central Bank reference rate of the day and already include the bank processing fees applicable to international payments. No surcharge is added at the payment stage.

    The amount displayed in the selected currency at the time of booking is the final amount that will be charged, including any balance collected at a later date. The Traveler's own bank may nevertheless apply its own fees, over which Homerez has no control.
    5. Booking

    Booking can be made in writing, by telephone, directly on the Website or on Third-Party Rental Platforms. The Lead Traveler is informed that Homerez is mandated to collect the total amount of the rental in the name and on behalf of the Principal.

    When booking the Accommodation, the Lead Traveler must indicate the exact number of Travelers (adults, children, babies) who will occupy the Accommodation. If this number should increase, they must immediately inform Homerez and the Principal, it being specified that this change may be refused or accepted in exchange for the payment of additional fees by the Principal. If the number of Travelers occupying the Accommodation exceeds the number indicated at the moment of the booking, the Principal may restrict entry to the premises to the indicated number of Travelers and refuse entry to the others.

    Option 1 / Booking less than 60 days before the arrival date
    The Lead Traveler will pay Homerez the total amount for the rental. This payment must be made immediately via one of the payment methods offered. Failing that, the Accommodation will not be booked. The rental becomes definitive when full payment has been made and the Lead Traveler has received confirmation by e-mail. The Lead Traveler will receive by e-mail, at least two weeks before the rental date, all relevant information and in particular the contact details of the person appointed by the Principal to welcome them and to fill in the inventory of fixture.

    Option 2 / Booking more than 60 days before the arrival date and for a total amount of more than €1,000
    The Lead Traveler must pay a deposit of 30% of the total amount (rental price and any additional fees). In the absence of payment of the full deposit, the booking will not be made and Homerez will be free to offer the Accommodation to another traveler. The payment of the deposit implies a firm booking. The balance of the total amount must be paid at the latest 60 days before the arrival date. If the Lead Traveler fails to pay the balance within this period, Homerez will be entitled to immediately terminate the rental agreement to the exclusive detriment of the Lead Traveler, who will then be charged a cancellation fee corresponding to the balance of the rental amount. If the Lead Traveler subsequently renounces the rented Accommodation or does not show up, they remain liable for the full amount of the rental minus the said deposit.

    Option 3 / Booking more than 60 days before the arrival date and for a total amount of less than €1,000
    The Lead Traveler will pay Homerez the total amount of the rented Accommodation immediately. Failing that, the Accommodation will not be booked. The rental becomes definitive when full payment has been made and confirmation has been received by e-mail.
    6. Cancellation Conditions

    The booking can be cancelled by the Lead Traveler free of charge up to 60 days before the start of the rental period. The amount already paid will be refunded within 72 hours following the cancellation.

    Cancellations made less than 60 days prior to the start of the rental period will result in the Lead Traveler paying a cancellation fee of 100% of the total rental amount. The deposit paid is retained by Homerez, and the Lead Traveler must therefore pay the balance of the rental within 72 hours following the cancellation.

    The Lead Traveler is informed that no compensation can be paid and that no price reduction can be applied in case of early departure from the Accommodation.

    The booking can be cancelled by the Principal without charge up to 24 hours before the start date of the rental period. For any cancellation resulting from the Principal, the Lead Traveler will be refunded the amounts paid to Homerez for the rental of the Accommodation.
    7. Cancellation Guarantee by HOMEREZ

    The Cancellation Guarantee by HOMEREZ allows you to cancel your stay within a period ranging from 60 days before your scheduled arrival date up to 24 hours before your stay. If you cancel within this period, you will be eligible for a full refund of your stay.

    To benefit from this cancellation guarantee, you must inform us of your decision by email by contacting our customer service at customer@homerez.com. Your cancellation request must be received by the 24-hour deadline prior to your scheduled arrival date.

    Please note that the cancellation guarantee is a chargeable service, and the corresponding fee will be added to the total amount of your booking. The cancellation guarantee fee is non-refundable, even if you decide not to use it. This cancellation guarantee is only valid for the specific booking to which it is associated and cannot be transferred to another booking.
    8. Security Deposit

    The security deposit must be paid to the Principal by the Lead Traveler in accordance with the terms set out in the advertisement. If the security deposit is not paid in accordance with those terms, the Principal may refuse entry of the Traveler(s) into the Accommodation. In this case, this refusal will not give rise to any claim whatsoever, this failure being deemed an early termination of the rental agreement to the exclusive detriment of the Lead Traveler.

    This security deposit is intended to cover any possible damage caused by the Traveler(s) to the accommodation and its furnishing, as well as the loss of keys or objects.

    The security deposit will be returned in full or in part within a maximum of 30 days after the end of the rental period, reduced by the sums necessary to cover damage and/or deterioration caused by the Traveler(s), as well as the loss of keys or objects.

    In any event, the Principal may retain the entire security deposit and, if applicable, request the payment of damages in the following cases:

    • Serious failure of the Traveler(s) to comply with the rules of hygiene;

    • Deterioration resulting in repair (or replacement) costs exceeding the amount of the security deposit, subject to proof being provided by the Principal.

    The Lead Traveler acknowledges that Homerez cannot be held responsible for the Principal's refusal to refund the sums paid for the security deposit.
    9. Inventory of Fixture

    The arrival and departure of the Lead Traveler and the Travelers must take place during the time slots set by the Principal and specified in the advertisement.

    The Lead Traveler undertakes to contact the Principal or the person authorised to represent him in the days before arrival and departure in order to set a precise schedule. If the Lead Traveler is prevented from arriving or is late for any reason, they must immediately inform the Principal in order to agree on a new schedule.

    An inventory of fixture and an inventory of the furniture made available will be given to the Lead Traveler upon entry into the Accommodation. If the inventory is not drawn up and signed by both parties at the same time, the inventory drawn up by the Principal alone may be contested by the Lead Traveler within 48 hours following the beginning of the rental period. Failing contestation within this 48-hour period, the inventory will be deemed to have been accepted without reservation.
    10. Obligations of the Lead Traveler

    The Lead Traveler undertakes personally and on behalf of the Travelers to:

    • use the rented Accommodation, furniture and equipment in a peaceful manner in accordance with the purpose for which they were intended, and to be liable for any damage or loss occurring during the period of occupancy;

    • respect the maximum number of persons that can enter the premises in accordance with the description;

    • maintain the rented Accommodation and return it in a good state of repair at the end of the rental period. If objects appearing in the inventory are broken or damaged, the Principal may claim their replacement value;

    • inform the Principal or the person entitled to represent him of any damage or deterioration to the Accommodation, even if there is no apparent damage;

    • return the Accommodation in a perfectly clean state. Failing this, they undertake to pay for the cleaning that the Principal will be obliged to carry out. If additional cleaning costs were charged at the time of booking, the Accommodation must still be returned in a good state of general cleanliness, including the removal of household waste and the cleaning of the kitchen and household utensils;

    • take out a comprehensive insurance policy to be protected against rental risks (water damage, fire, recourse from neighbours, etc.) and to justify this at the first request of the Principal;

    • not leave the premises prematurely without having previously informed the owner and Homerez, so that the inventory of fixture and the return of the keys can be carried out;

    • respect the instructions specified by the Principal in the advertisement concerning the use of the Accommodation, namely: no smoking, no pets allowed, maximum number of Travelers, etc. The number of Travelers authorised per accommodation is understood as the maximum capacity, adults and children included;

    • prohibit access to the swimming pool (private or collective) for minors not accompanied by an adult;

    • not make any changes to the furniture or the layout of the accommodation;

    • not oppose the visit of the Accommodation if the Principal so requests;

    • allow work to be carried out in the Accommodation during the rental period where obvious urgency does not allow it to be postponed;

    • avoid any noise likely to disturb the neighbours, in particular that emitted by radio equipment;

    • waive any recourse against the Principal or Homerez in the event of theft and damage happening within the rented premises.
    11. Responsibility of Homerez

    Homerez shall not be held responsible in case of:

    • failure of the Accommodation to comply with the information provided in the advertisement;

    • failure of the Accommodation to comply with the regulations relating to decent accommodations;

    • cancellation of the booking by the Principal;

    • cancellation attributable to an unforeseeable event or to a case of force majeure;

    • theft, burglary, assault and more generally any wrongful or criminal act committed in the accommodation;

    • unjustified refusal by the Principal to return the security deposit;

    • damage or loss resulting from war, threat of war, riots, terrorist activity, natural or nuclear disasters, fires, pandemics, administrative closures, travel bans, airport closures, adverse weather conditions, lack of supply of a network, action by the authorities, or any other case of force majeure as defined by law.
    12. Assignment and Sublease

    The seasonal rental of the Accommodation is concluded intuitu personae for the sole benefit of the Lead Traveler. Consequently, any sublease, whether total or partial, or any free provision of the Accommodation and/or its outbuildings, is strictly prohibited.
    13. Termination Clause

    In the event of a breach by the Lead Traveler of any of the conditions stipulated above, this rental will be terminated at the end of a period of 24 hours following a simple formal notice by registered letter or hand-delivered letter that has remained unsuccessful. Termination will take effect automatically without the need for any judicial formality.
    14. Penalty Clause

    It is stipulated as a penalty clause, in order to guarantee the owner the effective and immediate recovery of the rented premises, that the Traveler, in the event that they unduly remain on the premises at the end of the rental, must pay the owner an occupancy indemnity calculated, day by day, on the basis of the rental price increased by 50%.
    15. Invalidity

    If any clause of these general rental conditions is found to be void or unfair, the contract will remain applicable in all its provisions other than those deemed void or unfair, provided it can survive without those clauses.
    16. Protection of Personal Data

    These general conditions are subject to the provisions of European Regulation 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as well as to French Law No. 78-17 of January 6, 1978 on information technology, data files and civil liberties.

    Homerez needs to use the Lead Traveler's data to manage the booking and to put them in contact with the Principal. The Lead Traveler's data is kept for the duration of the commercial relationship and, beyond that, for a period of 3 years for commercial purposes, as well as for evidentiary and accounting obligations.

    The Lead Traveler has a right of access, portability, modification, restriction and deletion of data concerning them. These rights may be exercised by email at: privacy@homerez.com or by post at: 46 rue Notre Dame des Victoires 75002 Paris.
    17. Mediation - Applicable Law - Jurisdiction

    In accordance with French Order No. 2015-1033 of August 20, 2015 and implementing Decree No. 2015-1382 of October 30, 2015, any consumer dispute may be subject to amicable settlement through mediation via the online dispute resolution platform.

    To submit a dispute to the consumer mediator, the Client may complete the form available at this address: https://ec.europa.eu/consumers/odr

    These terms are governed, interpreted and applied in accordance with French law. Any dispute arising concerning their interpretation, modification or execution shall, failing an amicable agreement, fall under the exclusive jurisdiction of the French courts.
